TERMS OF USE — MAINSAFE AI SKILL MANAGER

These Terms of Use (“Terms”) govern access to and use of MainSafe AI Skill Manager, a service provided by RSA Consultoria e Treinamento Ltda., operating under the MainSafe / MainSafe Soluções brand, registered under Brazilian CNPJ No. 33.601.650/0001-41, with address at Avenida Amazonas, 115 – Sala 1102, Centro – Belo Horizonte – Minas Gerais – Brazil, hereinafter referred to as “MainSafe”.

By creating an account, accessing or using MainSafe AI Skill Manager, the user confirms that they have read, understood and agreed to these Terms and to the applicable Privacy Policy.

1. ABOUT MAINSAFE AI SKILL MANAGER

MainSafe AI Skill Manager is a platform designed to help users organize and manage reusable content and assets related to artificial intelligence, including, among others, Prompts, Skills, System Prompts, Agents, Plugins, Automations, Templates, text, files, references, versions and other materials added by the user.

Depending on the applicable plan and available features, the service may allow users to store, organize, find, version, download and share certain content.

MainSafe AI Skill Manager is not an artificial intelligence content-generation platform and does not guarantee the performance, quality, accuracy or suitability of Prompts, Skills, Agents or other materials stored by users when such materials are used with third-party tools or services.

2. ELIGIBILITY

MainSafe AI Skill Manager is intended exclusively for individuals who are 18 years of age or older.

By using the service, the user represents that they have the legal capacity to accept these Terms and use or purchase the services offered.

The current version of the service does not provide a specific parental-consent flow or a service intended for minors.

3. ACCOUNT CREATION AND SECURITY

Access to MainSafe AI Skill Manager may use third-party authentication services, including authentication through a Google account.

The user is responsible for maintaining the security of the methods used to access their account and for preventing unauthorized use by third parties.

MainSafe may use authentication, session-control, security and fraud-prevention mechanisms that are reasonably necessary to protect the platform and its users.

The user should notify MainSafe as soon as reasonably possible if they suspect unauthorized access to their account.

4. USER CONTENT

The user retains any rights they lawfully hold in content added to MainSafe AI Skill Manager.

Simply storing content on the platform does not transfer ownership or intellectual property rights in that content to MainSafe.

The user is responsible for ensuring that they have the rights, licenses, permissions, authorizations or legal grounds necessary to store, use, download or share content through the platform.

This includes copyrighted materials, confidential information and personal data relating to third parties.

5. TECHNICAL LICENSE REQUIRED TO PROVIDE THE SERVICE

By using MainSafe AI Skill Manager, the user grants MainSafe a limited, non-exclusive, worldwide, royalty-free license solely to the extent technically necessary to host, store, process, technically reproduce, transmit, back up, restore, display to the user or authorized recipients, and otherwise perform operations necessary to provide, protect and operate the service.

This license does not transfer ownership of the content to MainSafe and does not authorize MainSafe to independently commercially exploit the user’s content.

The license may continue on a limited basis where residual copies need to remain in technical backups or where retention is required by applicable law.

6. PRIVATE CONTENT AND AI MODEL TRAINING

MainSafe does not use private content stored by users to train its own artificial intelligence models or third-party artificial intelligence models.

Private user content is also not used by MainSafe for advertising purposes.

If this policy is changed in the future, any such use would require an appropriate specific feature, adequate transparency and an applicable legal basis before implementation.

7. USER RESPONSIBILITY FOR CONTENT

The user is responsible for the content they choose to create, store, upload, share or otherwise make available through the platform.

This responsibility includes the legality of the content, respect for third-party rights and, where applicable, the existence of an adequate legal basis or authorization for the processing of personal data.

MainSafe does not automatically assume responsibility for unlawful acts, improper processing or violations carried out exclusively by the user or third parties.

Nothing in this provision excludes or limits MainSafe’s own obligations under applicable law, including obligations relating to security, personal data protection, incident response and other responsibilities legally attributable to MainSafe.

8. ACCEPTABLE USE

MainSafe AI Skill Manager may not be used for illegal, fraudulent, abusive or malicious activities or for activities that violate third-party rights.

Prohibited uses include, among others, storing or distributing malware, phishing materials, credential-stealing tools, materials intended to facilitate unauthorized access, exploitation or circumvention of security controls, fraud, intellectual property infringement, attempts to bypass storage quotas or technical limits, abusive automation that may harm the infrastructure, sexually explicit or pornographic content, and content whose possession or distribution is unlawful.

It is strictly prohibited to store, share or distribute material involving the sexual exploitation or sexual abuse of children or adolescents.

MainSafe does not conduct indiscriminate human monitoring of all private content stored by users.

However, MainSafe may investigate specific situations when there are indications of abuse, reports, security risks, fraud, legal obligations or a need to protect users, third parties or the platform itself.

9. ACTIONS AGAINST ABUSE

Depending on the nature and severity of the situation, MainSafe may take measures including warnings, limitation of features, making content unavailable, removal of content, temporary suspension or account blocking.

Where reasonably possible, measures should be proportionate to the circumstances identified.

Immediate action may be taken when necessary to address fraud, security risks, illegal activity, infrastructure threats or legal obligations.

Restrictions resulting solely from storage quota limits are separate from administrative account blocking.

10. PLANS

MainSafe AI Skill Manager currently offers the following plans:

Free — US$0
Total storage limit: 50 MB.

Personal — US$5 per month
Total storage limit: 2 GB.

Personal Plus — US$10 per month
Total storage limit: 5 GB.

New users start on the Free plan unless MainSafe expressly provides otherwise.

MainSafe may change plans, features, quotas or pricing for future subscriptions, subject to applicable rights relating to existing users and subscriptions.

11. MAXIMUM FILE SIZE

The technical maximum size for an individual file is up to 100 MB, always subject to the storage capacity still available under the user’s plan.

The 100 MB maximum individual file size does not increase the total storage quota of the applicable plan.

12. STORAGE QUOTAS

Users must keep their storage usage within the quota applicable to their plan.

Certain operations may be restricted when they would cause usage to exceed the applicable limit.

Items in Trash continue to count toward storage usage while they remain restorable.

13. PLAN CHANGES

Requests to change plans are handled through MainSafe’s assisted plan management process.

Payment alone does not mean that a plan change has been immediately applied.

Activation or modification of a plan may depend on administrative validation and application of the requested change by MainSafe.

For a downgrade from Personal Plus to Personal, the user must be within the Personal plan’s 2 GB storage quota before the downgrade can be definitively applied.

While a downgrade request remains active, the platform may operationally apply the target plan’s storage limit to prevent the user from increasing storage usage beyond the level compatible with the requested downgrade.

14. PAYMENTS

Paid plans are billed in United States dollars (USD).

Payments are processed through Stripe using Stripe Payment Links or other payment mechanisms that MainSafe may make available.

Payment-method information is entered directly in the environment provided by Stripe.

MainSafe does not receive or store the full credit card number or card security code (CVV).

MainSafe may receive and process payment-related information necessary to administer subscriptions, such as payment status, plan information, dates, billing identifiers and other information made available by Stripe.

15. SUBSCRIPTIONS AND RENEWAL

Personal and Personal Plus are monthly recurring subscriptions billed in United States dollars.

While a subscription remains active, recurring charges may be processed by Stripe according to the applicable billing cycle.

The subscription continues until it is cancelled or otherwise terminated under these Terms.

16. SUBSCRIPTION CANCELLATION

Users may request cancellation of a paid subscription.

Cancellation takes effect at the end of the current paid billing period unless applicable law requires a different treatment.

Until the end of that paid period, the user may continue to use the benefits of the paid plan.

After the paid subscription ends, the account returns to the Free plan.

Cancellation of a subscription does not mean deletion of the user’s account.

17. STORAGE REGULARIZATION AFTER RETURNING TO FREE

If an account returns to the Free plan while using more than 50 MB of storage, content will not be immediately deleted.

A 30-day storage regularization period will begin.

During this period, the user may view, download or delete content, reduce storage usage or subscribe again to a compatible plan.

Operations that would further increase storage incompatibility with the Free quota may be restricted.

If storage remains above the Free limit after the regularization period, assets owned by the user may be administratively moved to Trash when the applicable regularization process is performed.

MainSafe does not guarantee that this administrative action will occur at the exact moment the 30-day period expires.

18. TRASH

Content moved to Trash remains restorable for up to 30 days, according to the available functionality.

After that period, the content becomes eligible for permanent deletion from the operational environment.

MainSafe does not guarantee physical deletion at the exact moment the 30-day period expires.

19. TECHNICAL BACKUPS

For disaster recovery, security and service continuity purposes, MainSafe may maintain technical backup copies separate from the operational storage normally used by users.

After content has been removed from the operational environment, residual copies may remain in restricted-access technical backups until they are deleted according to MainSafe’s technical retention and deletion cycles or as required by applicable law.

Technical backups are not presented to the user as active storage or a normal content library and are primarily intended for technical recovery, security, continuity and disaster-recovery purposes.

20. FAILED PAYMENTS

If a recurring payment cannot be completed, MainSafe or the payment provider may make or await additional payment attempts or request regularization.

MainSafe does not guarantee a fixed number of payment attempts or a fixed grace period.

If the payment is not regularized and no paid subscription period remains, the account may return to the Free plan.

If storage usage exceeds the Free quota, the storage regularization rules described in these Terms will apply.

21. CHARGEBACKS, PAYMENT DISPUTES AND SUSPECTED FRAUD

Chargebacks, payment disputes, payment reversals, suspected fraud or other payment irregularities may be reviewed administratively.

Submitting a chargeback does not automatically result in account blocking.

Depending on the circumstances, MainSafe may restrict paid benefits, suspend certain features or take other measures reasonably necessary to protect the platform, prevent abuse or comply with legal obligations.

22. REFUNDS

Except where required by applicable law or where a billing error is recognized, payments already made are not proportionally refundable solely because a user cancels a plan.

MainSafe may review individual circumstances on a case-by-case basis.

Mandatory consumer rights provided by applicable law remain preserved, including any legally applicable withdrawal, cancellation or refund rights that cannot be contractually waived.

23. ASSET SHARING

Asset-sharing functionality is available according to the applicable plan and current service rules.

Currently, only eligible users on paid plans may share their own assets.

Free-plan users may receive certain shared assets and, depending on the permission granted, may view or download shared content.

Sharing is private and intended for identified users of the platform.

The current service does not provide unrestricted public sharing of assets.

24. SHARED VERSIONS

A share references a specific version of an asset.

Creating a new version of the asset later does not automatically replace the version that was originally shared.

The asset owner may revoke sharing according to the functionality available in the service.

25. SHARING PERMISSIONS

The platform may provide different permission levels, including:

View and download; or

View, download and create a copy in My Assets.

The ability to create a copy depends on the permission granted by the asset owner and the recipient having sufficient available storage quota. A Free-plan recipient may create a copy when the sharing permission allows viewing, downloading and copying, provided that sufficient storage quota is available.

26. COPIES OF SHARED ASSETS

Where permitted, creating a copy in “My Assets” creates a new operational asset associated with and controlled through the recipient’s account.

The copy is independent from the original asset.

Revoking the original share does not automatically delete a copy that the recipient has already created.

Creating a copy does not automatically constitute an assignment or transfer of copyright, licenses or other intellectual property rights relating to the original content or third-party materials.

The user sharing content is responsible for having the rights necessary to grant the access, download or copying permissions selected.

27. ATTACHED FILES IN COPIED ASSETS

Certain copying features may reproduce the structured information of an asset without automatically cloning all attached files into storage.

The interface may inform the recipient when files need to be downloaded and added again manually.

28. CONTENT CONTAINING PERSONAL DATA OF THIRD PARTIES

Users may, under their responsibility, insert personal data relating to third parties into Prompts, Skills, Agents, files, notes or other content.

Where MainSafe merely hosts or processes such data to provide the service according to the user’s instructions, MainSafe’s role may be that of a processor or operator, depending on applicable law and the actual circumstances of the processing.

The user is responsible for the purposes they determine for such processing and for having an appropriate legal basis for personal data relating to third parties that they choose to insert into the service.

Where MainSafe itself determines the purposes and essential elements of processing, including account management, billing, security, support and compliance with legal obligations, MainSafe acts according to its own applicable role as a data-processing agent.

29. THIRD-PARTY SERVICES AND PROVIDERS

MainSafe may use specialized third-party providers to operate and provide the service.

These providers may include:

Google, for authentication;

Stripe, for payment processing and subscriptions;

Cloudflare and related services, for infrastructure, security and storage.

These services have their own applicable terms, policies and responsibilities.

MainSafe may replace or add providers when reasonably necessary for operation, security or evolution of the service.

30. INTERNATIONAL DATA TRANSFERS

Operation of the platform may involve infrastructure or service providers located in Brazil or other countries.

Where international transfers of personal data occur, MainSafe will adopt the measures and mechanisms applicable under data-protection laws.

31. SECURITY

MainSafe adopts technical and administrative measures designed to protect the platform and the information processed through it.

However, no Internet-connected service can guarantee absolute security, complete absence of failures or zero risk.

Users must also take reasonable steps to protect their accounts and content.

32. SERVICE AVAILABILITY

MainSafe AI Skill Manager is an online service intended to remain continuously available, but it does not provide a formal service-level agreement guaranteeing 100% availability.

Interruptions may occur because of maintenance, updates, technical failures, security measures, Internet failures, third-party infrastructure, force majeure or other circumstances affecting operation of the service.

33. SUPPORT

Human support for MainSafe AI Skill Manager is provided Monday through Friday on business days through:

MainSafe aims to respond to support requests normally within 1 business day, but this target does not constitute a service-level agreement or guaranteed response time.

34. MAINTENANCE

Scheduled maintenance that may cause material service unavailability will be communicated in advance whenever reasonably possible, preferably at least 24 hours beforehand.

Emergency maintenance may be performed without prior notice where necessary for security, correction of serious failures, service stability, third-party provider outages, personal-data protection or infrastructure protection.

35. CHANGES TO FEATURES

MainSafe may correct, update, improve, modify or discontinue certain service features.

Where a material change may significantly affect use of the platform, MainSafe will seek to provide reasonable advance notice where possible, subject to contractual rights and mandatory applicable law.

36. ACCOUNT DELETION

The system currently does not provide an automated self-service feature for permanent account deletion.

Requests for permanent account deletion may be submitted to:

Requests will be handled administratively according to applicable technical, contractual and legal requirements.

Account deletion is different from cancellation of a paid subscription.

37. ACCOUNT SUSPENSION OR TERMINATION

MainSafe may suspend or block an account in circumstances including violation of these Terms, fraud, abuse, significant security risks, unlawful use or where necessary to comply with legal obligations.

Where reasonably possible and compatible with the identified risk, MainSafe may provide information about the action taken.

Urgent circumstances may require immediate action.

38. DISCONTINUATION OF THE SERVICE

If MainSafe decides to permanently discontinue MainSafe AI Skill Manager, MainSafe will seek to provide users with reasonable advance notice.

Where technically possible, users will be given an opportunity to download or export their content before the service is discontinued, subject to technical limitations, security requirements and applicable legal obligations.

39. LIMITATIONS OF LIABILITY

MainSafe does not guarantee that Prompts, Skills, Agents or other stored content will produce any particular result when used with artificial intelligence platforms or third-party services.

MainSafe does not control changes, outages, responses, behavior or policies of external platforms where users may choose to use their content.

To the extent permitted by applicable law, MainSafe will not be responsible for losses or damages resulting exclusively from acts of the user or third parties, misuse of the platform, or content inserted without the required rights, permissions or authorizations.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

40. CONSUMER RIGHTS

Nothing in these Terms is intended to eliminate mandatory consumer rights granted by applicable law.

Where a user is protected by mandatory consumer laws in their country or jurisdiction of residence, such rights remain preserved to the extent they cannot legally be waived by contract.

41. CHANGES TO THESE TERMS

MainSafe may update these Terms because of legal, regulatory, technical, commercial, security or functional changes.

Material changes will be communicated to users with reasonable advance notice where possible.

The updated version and its applicable effective date will be made available through MainSafe’s official channels.

42. PRIVACY POLICY

Processing of personal data in connection with MainSafe AI Skill Manager is also governed by the Privacy Policy, which forms part of the documents applicable to the service.

43. GOVERNING LAW

These Terms are primarily governed by the laws of the Federative Republic of Brazil, without prejudice to mandatory consumer-protection and data-protection laws applicable to users in their jurisdiction that cannot legally be waived by contract.

44. JURISDICTION

Where legally permitted, the courts of Belo Horizonte, State of Minas Gerais, Brazil, shall have jurisdiction over disputes relating to these Terms.

This provision does not prevent consumers from exercising rights before another competent court where mandatory applicable law grants them such a right.
